Samsung Tries to Tie Up Oz iPhone Sales By Claiming 3G Tech

It appears that phase 2 in what is quickly becoming something of a bona fide patent war has commenced, with Samsung seeking injunctions on the newly launched iPhone 4S, in Japan and right here in Australia, on the basis of a variety of patents held in Japan, and also right here in Australia.

While the claims made in Japan mostly relate to user interface patents, not least of which is a patent on navigating a tree-like structure (or "app store") to find and install apps, the Australian claims mainly have to do with 3G patents.

Two of the patents relate to HDSPA connection technology, the third to WCDMA, according to a press release issued by Samsung.

We'll interested to see how the Australian case goes, especially given that a remarkably similar attempt to injunct on the basis of 3G technologies was recently rejected by a Dutch court on the basis of the essential nature of the technology to the telecommunications industry.

It was further ruled that the technology should therefore should be made available for licensing as a common standard.

Quite what this ruling means for the Australian case, we're not certain, but it looks like Samsung are going to do what they can, saying, "Apple has continued to violate our patent rights and free ride on our technology. We will steadfastly protect our intellectual property."

This fresh case follows on from Apple's recently successful bid to have an injunction taken out against local sales of the Galaxy Tab 10.1.

The iPhone 4S itself was only released locally on Friday, following hot on the heals of the iOS 5 update.

We can't help but feel that the whole thing resembles a patent Cold War.
